A Freshfields trainee solicitor sued her firm for more than half a million GBP for personal injury, loss of career and physiological distress after a business trip to Ghana. Cawthorn contracted Shigella dysentery after eating fresh barracuda and following her illness and absence from work, sued her employer, claiming they were negligent for not ensuring that she was appropriately advised on recommended vaccinations or dietary risks.
A UK employee assigned to West Africa caught and died from malaria. His employer advised him to seek travel health advice before leaving the UK, however he failed to do so. His widow sought a claim for damages against the company and won. The court stated that the employer had breached their duty of care, and that their minimum responsibility to the employee was to ascertain and make available information on the health hazards.
